Police no longer come to your door to settle domestic squabbles between you and your spouse or your children and then leave when the parties cool down and apologies are given.
Once the feuding parties are seperated, the officers interview the "victim" and convince her to give a written statement. Sometimes when the victim refuses to give a statement, it's suggested that she could be arrested for filing a false police report. Angry words between the parties are taken down by police and the children, if present, are interviewed. Photographs of any bruises or cuts are taken.
Then someone, usually the husband or boyfriend, is taken to jail and released the following day (if no serious injury occurred). However, frequently a no-contact bond is made a condition of his release and he has to find a new place to live.
If contacted immediately, an attorney can get the no contact-provision removed and restore the defendant to the home.
The victim is usually surprized when her spouse or boyfriend is taken away and doesn't realize that she cannot get the charges dropped. Legal help is necessary to avoid a criminal record and assure the defendant is afforded the best and least costly outcome to his case.
